Company Restoration

Crichtons can refer you to solicitors who would help you in defending company directors who are prosecuted for failing to comply with their statutory obligations.

It is not widely known that such prosecutions can have very serious consequences:

Firstly, a successful prosecution results in a criminal conviction.

Secondly, the maximum penalty for a typical s.242 Companies Act prosecution is £5,000 (although first offence convictions would generally result in a much lower fine, particularly if the company director is legally represented).

Thirdly, "multiple-charge" prosecutions are often brought; a third conviction (which would be very likely if say both accounts and annual returns were not filed for a two-year period) can result in disqualification as a company director.
